Groton Conservation Commission unanimously rejects a patio expansion as incremental creep under local wetlands bylaw. The commission voted 6-0 at its July 28 meeting to find that a proposed patio enlargement and step walkway at 65 Riding Road does not qualify as a minor modification to an existing notice of intent, with Member Olin Lathrop calling it "a textbook case of incremental creep" prohibited by the Groton Wetlands Protection Bylaw. The applicant's civil engineer, James, had argued that pervious pavers and crushed stone would introduce no new impervious surface and that two 22-inch oak trees on the site would be protected with tree wells and a landscape architect, but members including Bruce Easom and Vice Chair Laurence J.

Hurley said grading changes requiring multiple retaining walls and fill of more than three feet made the scope far too large for a minor change. In other action, the commission authorized a $900 payment to Bay State Forestry Service for herbicide retreatment of black swallowwort at Nipmuc Meadows, set an August 21 deadline for the owner of 65 West Main Street to submit a conservation land restoration plan, and directed Conservation Administrator Charlotte Steeves to send enforcement letters to all parties associated with the long-unresolved Lost Lake Realty Trust matter.
